Absence of U.S. Regulation Leads to Web Accessibility Lawsuits

In the absence of clear U.S. government regulation or even clear guidance, there have been many web accessibility lawsuits that simultaneously bring attention to web accessibility and, perhaps unfairly and unnecessarily, cost well-intentioned businesses money.

Is it really possible for a defendant to win an ADA case? The answer is yes, and it is worth looking at a couple of recent cases to see how. The first is Rocca v. Den 109 LP, 2015 WL 5601810 (C.D. Cal. Sept. 23, 2015). In Rocca the plaintiff, like many ADA plaintiffs, had a laundry list of alleged violations, some real, some not, and some trivial.

That is what the Tenth Circuit’s held in Colorado Cross Disability Coal. v. Abercrombie & Fitch Co., 2014 WL 4290589 (10th Cir. 2014) when it reaffirmed what businesses have always believed; that is, that the 2010 Standards and their predecessor the ADAAG are a real safe harbor for business.*
